Welcome to Rochester.MomCollective.com. This website is operated by Rochester Mom Collective, LLC (“Rochester Mom Collective” “Us,” “We,” or similar terms). The following terms and conditions, together with the privacy policy (collectively, the “Terms”) govern your access to and use of Rochester.MomCollective.com, including any content, functionality and services offered on or through Rochester.MomCollective.com (the “Website”).

Please read these terms carefully, and keep a copy of them for your reference. By using the Website, or by clicking to accept or agree to the Terms when this option is made available to you, you agree to be bound by the Terms. We grant you a non-exclusive, non-transferable, limited license to access, view, download and print the information, documents, text, images, software, and other content and elements of the website (collectively, the “Content”) solely in accordance with these Terms and solely for your personal, non-commercial use. We may terminate the above license at any time for any reason.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, or republish any of the Content without prior written consent from us. If you print, copy, modify, download or otherwise use or provide any other person with access to any part of the Website or Content in breach of the Terms, your license will terminate immediately, automatically, and without notice. User Submissions

Rochester Mom Collective does not claim ownership of the materials you provide to Rochester Mom Collective (including photos, copyright, feedback and suggestions) or post, upload, input or submit to any Rochester Mom Collective Website or our associated services (collectively “Submissions”).  When you upload or otherwise submit Submissions to the Website, you give Rochester Mom Collective a worldwide, perpetual, unlimited, non-exclusive, transferable, sub-licensable, royalty-free, license to use, host, store, reproduce, modify, create derivative works, communicate, publish, perform, display and distribute Submissions, solely for the purposes of: (i) operating the Website and business, (ii) sharing Submissions with third parties as necessary to operate the Website and as consistent with the Privacy Policy; and (iii) sharing Submissions with persons that you specify. By posting, uploading, inputting, providing or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission including photos and copyright as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.

No Unlawful or Prohibited Use

As a condition of your use of the Website, you warrant to Rochester Mom Collective that you will not use the Website for any purpose that is unlawful or prohibited by these Terms. You agree that you are responsible for all postings or other activity performed using your username and password.

Rochester Mom Collective reserves the right to modify the Terms from time to time in our sole discretion, such modifications to be effective upon posting and to apply to all use of the Website thereafter. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
